Terms of Service
Last updated:
The short version
The free mockup carries no obligation. Prices are "starting at" and you get a fixed written quote before paying. Once your project is paid in full, your website is yours. Care plans are month-to-month. Florida law applies.
These Terms of Service ("Terms") are an agreement between you and ByteCode Insight ("ByteCode Insight," "we," "us"). They cover (a) your use of bytecodeinsight.com and our free tools (the "Site"), and (b) any web design, hosting, care plan or IT services you buy from us (the "Services"). By using the Site or the Services, you agree to these Terms. If a written proposal, quote or invoice we send you ("Proposal") conflicts with these Terms, the Proposal controls for that project.
Part A — Using the Site and free tools
1. Free tools
Our free tools (such as the Domain Name Checker, QR Code Generator and Image Compressor) are provided "as is" and "as available," without warranties of any kind. Results are informational:
- Domain availability is based on public registry data at the moment you check. A domain shown as "likely available" may be reserved, premium-priced or registered by someone else before you buy it. Always confirm with a domain registrar.
- QR codes and compressed images should be tested before you print or publish them. You are responsible for the content you encode or upload.
- Website Check scores (when available) are automated estimates from third-party services, not a professional audit.
2. Acceptable use
Don't use the Site to break the law, infringe others' rights, send spam, attempt to gain unauthorized access, overload our systems, or run automated bulk queries against our tools.
3. Site content
The Site's design, text, graphics, logos and code belong to ByteCode Insight or its licensors. Portfolio items labeled "Design concept" are sample websites we created to show our style; any business names in them are placeholders and they are not client work. You may not copy or reuse Site content except as the law allows.
Part B — Web design services
4. Free homepage mockup
Requesting a free mockup creates no obligation to buy. Until you purchase a plan, the mockup design and its code remain our property and you may not use, copy or have someone else build from them. We may reuse general layouts, techniques and components in other work, but not your business-specific content.
5. Quotes and pricing
Prices on the Site are starting prices. Your final price depends on scope — number of pages, features (such as online booking, an online store or a bilingual site), content and integrations. Before you pay anything, we'll send a Proposal with the fixed price, what's included and the estimated timeline. Work that falls outside the Proposal is quoted separately and starts only after you approve it in writing (email or text counts).
6. Payment
Unless your Proposal says otherwise: 50% is due to start the build after you approve the mockup and Proposal, and the remaining 50% is due before the site goes live. Invoices are due on receipt. If a payment is more than 15 days late, we may pause work, and for hosted sites or care plans we may suspend the service after giving you notice. Prices are in U.S. dollars and do not include sales tax where it applies, or third-party costs (domain registration, premium plugins, stock photos, paid apps) unless the Proposal says so.
7. Your responsibilities
You agree to:
- provide content, feedback and approvals in a reasonable time — if a project is on hold waiting on you for more than 30 days, we may close it and invoice the work completed;
- review your site before launch and tell us about any errors;
- only give us materials (text, photos, logos, trademarks) that you own or have permission to use, and make sure your business information and claims on your site are accurate and lawful.
8. Revisions
Your Proposal states how many revision rounds are included (if it doesn't say, two rounds on the design and one round on the finished site). Additional changes or new features are billed at the hourly rate or price in your Proposal.
9. Ownership
When your project is paid in full:
- you own the final design, the text and images you provided, and the custom content we created specifically for your site;
- you receive a perpetual, non-exclusive license to use any of our pre-existing code, templates and tools that are part of your site, for your site;
- third-party items (fonts, stock images, plugins, frameworks, platforms) remain subject to their own licenses.
We register domains in your name whenever possible so you always control them. Until full payment, all work remains our property.
10. Portfolio
We may display your finished website (screenshots, a link and a short description) in our portfolio and marketing. If you'd rather we didn't, tell us in writing and we'll remove it within a reasonable time. We will only publish testimonials or reviews you actually gave, with your permission.
11. Search rankings, results and accessibility
We build sites with an SEO-ready structure and follow accessibility best practices (WCAG 2.1 AA as a target), but we do not guarantee search rankings, traffic, leads or sales, because these depend on Google, competitors and factors outside our control. Accessibility and legal compliance of your site also depend on the content you add and changes made after launch; we recommend periodic accessibility reviews, and we can provide them as a separate service.
12. Post-launch fixes
For 30 days after launch, we'll fix defects in the work we delivered at no charge. This doesn't cover new features, content changes, or problems caused by edits made by others, third-party services or updates outside our control.
Part C — Hosting and care plans
13. Care plans
Care plans are month-to-month and billed in advance. The plan description or Proposal lists what's included (for example hosting, SSL, a set amount of content edits, backups and security updates); unused edits don't roll over. You can cancel at any time by telling us before your next billing date; the plan stays active until the end of the paid period, and partial months aren't refunded. We may change plan pricing with at least 30 days' notice.
14. If you leave
If you cancel hosting or a care plan, we'll give you your website files and help you move to another provider, as long as your account is paid up. Reasonable migration work beyond handing over the files may be billed hourly.
15. Third-party services
Your website relies on providers we don't control, such as hosting companies, domain registrars, Google, payment processors and messaging apps. We aren't responsible for their outages, policy or price changes, or data handling, though we'll help you deal with issues covered by your plan.
Part D — IT services
16. Before we work on your devices
Please back up your data before any repair, upgrade or network work. We take reasonable care, but devices can fail during service because of pre-existing problems, and we are not responsible for data loss or hardware failure that wasn't caused by our negligence. Diagnostics may be billed even if a repair isn't possible or you choose not to proceed; we'll tell you the cost first. You confirm that you own the devices and software we work on or are authorized to have us service them.
Part E — General
17. Termination
Either party may end a project with written notice. You'll pay for work completed up to the termination date (and any non-refundable third-party costs we incurred for you), and we'll deliver the work you've paid for. Deposits cover work already scheduled and performed and are refundable only for the portion of work not yet started. We may suspend or end Services if you seriously breach these Terms.
18. Disclaimer of warranties
Except as stated in section 12 and as required by law, the Site and Services are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
19. Limitation of liability
To the fullest extent permitted by law: (a) our total liability for any claim related to the Site or Services is limited to the amount you paid us for the specific Service giving rise to the claim in the 12 months before the claim, and (b) neither party is liable for indirect, incidental, special or consequential damages, such as lost profits or lost data. These limits do not apply to liability for gross negligence, intentional misconduct or fraud, or to any liability that cannot be limited under Florida law.
20. Indemnification
You agree to defend and hold us harmless from claims arising from content or materials you provide, your use of the website we build after delivery, or your violation of these Terms or of others' rights.
21. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, both parties agree to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to reach a solution. Any lawsuit must be brought in the state or federal courts located in Orange County, Florida, and both parties consent to their jurisdiction. Either party may bring a qualifying claim in small claims court.
22. Other terms
These Terms and any Proposal are the entire agreement between us about their subject and replace earlier discussions. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver. You may not transfer your rights under these Terms without our consent. Neither party is liable for delays caused by events beyond its reasonable control. We may update these Terms by posting a new version on this page; changes don't affect Proposals already signed.
